Terms and Conditions

OF USE OF THE ZÁSILKOVNA APPLICATION

effective from 10.11.2025

1 Introductory provisions

  1. Zásilkovna s.r.o., with its registered office at Českomoravská 2408/1a, Libeň, 190 00 Prague 9, ID (Identification Number) 28408306, registered in the Commercial Register maintained by the Municipal Court in Prague, file no.: C 139387 (hereinafter referred to as "Zásilkovna") issues these conditions (hereinafter referred to as the "Conditions") of use of the Zásilkovna Application (hereinafter referred to as the "Application").

  2. These Conditions govern the contractual relationship between Zásilkovna and the User of the Application.

  3. The Application is a software tool for submitting Shipments, quickly and simply informing the Sender and Recipient about the status of the Shipment, providing information on the options for specific Pick-up Points and Drop-off Points according to the location of the Sender and the Recipient, and tracking the archive of Shipments. Through the Application, it is possible to transfer the Code for submitting the Shipment and the password for collecting the Shipment, transmit information in the form of notifications, and pay the Commission for transport or C.O.D. (Cash on Delivery) for the Shipment. It is also possible to collect the Shipment from the Z-BOX via the Application. The Application further allows the User to set delivery preferences, which influence the Automatic Shipment Redirection of the Shipment in the event of full capacity of the target ZBOX (hereinafter referred to as "Functionalities").

  4. The Application is intended for devices with the Android 5 or higher or iOS 11 or higher operating system.

  5. The Zásilkovna Application is a copyright work within the meaning of the Copyright Act and the exercise of all proprietary rights to the Application belongs to Zásilkovna.

  6. The operator of the Application is Zásilkovna.

  7. The Sender and the Recipient may be Users utilizing the Application Functionalities (hereinafter referred to as the "User").

  8. The Application is accessible by downloading from the AppStore, or Google Play and/or by other means determined by Zásilkovna.

2 Conclusion of a contract for the use of the Zásilkovna Application

  1. The User's registration in the Application is the acceptance of the proposal for the conclusion of a contract for granting a license to use the Application. By concluding the contract, the User expresses their consent to these Conditions.

3 Use of the Zásilkovna Application, Rights and Obligations of the Contracting Parties

  1. Zásilkovna grants the User a non-exclusive license to use the Application to the extent and under the conditions specified in the Application's user environment.

  2. Zásilkovna is entitled to make the User's user account inaccessible after the license period expires.

  3. The User may not set up more than one user account.

  4. The User does not have the right to grant a sublicense to a third party to use the Zásilkovna Application.

  5. Zásilkovna has the right to change the Application (or a part of it) at any time, and in the event of the User violating the contract, Conditions, or legal regulations, Zásilkovna may make the Application inaccessible to the User.

  6. The User may terminate the use of the Application at any time by simply uninstalling the Application from the device where the application is downloaded. The User is not entitled to any compensation from Zásilkovna in connection with the use and/or uninstallation of the Application.

  7. The User has the right to use the Application under these Conditions in the current version available on the AppStore or Google Play. The User agrees not to interfere with or prevent updates.

  8. The User undertakes to act when using the Zásilkovna Application in such a way as not to cause damage to anyone.

  9. Zásilkovna and the User hereby declare and make undisputed that the Application meets the conditions of Section 562 paragraph 2 of Act No. 89/2012 Coll., the Civil Code, i.e., that the records of data in the Application and its database as an electronic system are reliable and are carried out systematically and sequentially and are protected against changes.

4 Procedure for Using the Application when Submitting a Shipment

  1. To submit a Shipment within the "Mezi námi" service, the Application must be installed. The User (Sender) shall subsequently fill in the Shipment data in the Application in accordance with the provisions of the Mezi námi Conditions.

  2. When filling in the Recipient's data for the Shipment, the Application uses the contact directory contained in the User's device, whereby the Application is entitled to display exclusively the data of the contact that the User selects as the Recipient of the Shipment. Other contacts from the User's directory are hidden from the Application.

  3. In the case of submitting a Shipment via Z-BOX, the User may use GPS navigation to find the nearest Z-BOX. The Application does not collect any data on the User's location in such a case.

  4. To submit a Shipment to the Z-BOX via the Application, the User must have Bluetooth and GPS enabled on the mobile device, which enables communication with the individual Z-BOXs. The Application does not collect any data on the User's location in this case either. It is also possible to submit a Shipment to the Z-BOX without the Application.

5 Procedure for Using the Application when Collecting a Shipment

  1. When collecting a Shipment from the Z-BOX via the Application, the User must have Bluetooth and GPS enabled on the mobile device, which enables communication with the individual Z-BOXs. The Application does not collect any data on the User'slocation in this case. It is also possible to collect the Shipment from the Z-BOX without the Application.

  2. The Application is only authorized to start collecting data on the User's location in the event of a problem occurring during the collection of the Shipment (e.g., the Z-BOX cannot be opened), for the purpose of efficient resolution of such a problem.

6 Setting Delivery Preferences

  1. The User is entitled to set their delivery preferences in the Application, which influence the Automatic Shipment Redirection process. If the User does not set preferences, the default option "As soon as possible to a Z-BOX" shall apply“.

  2. The User may select one of the following preferences in the event that the Shipment cannot be delivered to the original Delivery place:

    • “As soon as possible": The Shipment may be redirected to any of the favourite Z-BOXs or Pick-up Points selected by the User, or to another available place. Within this preference, the User may set up to 5 favourite Z-BOXs and 2 favourite Pick-up Points..

    • "As soon as possible to a Z-BOX": The Shipment may be redirected to any of the favourite Z-BOXs selected by the User. The User may set up to 5 favourite Z-BOXs..

    • "I will wait for the original place": The Shipment is delivered only to the original Delivery place, in up to two attempts carried out over two business days. A Shipment with this preference may be automatically redirected after the second delivery attempt is unsuccessful. In such a case, it is redirected to the nearest possible Pick-up Point.

  3. Shipments that cannot be delivered to the original Delivery place are automatically redirected according to the User's preference stated in the Application at 22:10 on the previous calendar day. A change in delivery preference in the Application shall only apply to newly accepted Shipments.

  4. The User acknowledges that in the event of Automatic Shipment Redirection, they will be sent a notification with information about the new Delivery place.

7 Payment of Commission for Transport and C.O.D. via the Application

  1. The User is entitled to pay the Commission pursuant to Article 6 of the Conditions or the C.O.D. for the Shipment directly in the Application in accordance with the relevant provisions of the Mezi námi Business Conditions (hereinafter referred to as the "Payment").

  2. For Payment via a payment card, the User is obliged to enter their payment card details into the Application. It is up to the User's discretion whether to save the data in the Application or whether to enter it again with each C.O.D. payment. The User may remove saved data at any time.

  3. During the Payment, the User shall confirm the payment via the saved payment card. In the case of C.O.D. payment amounting to less than 10 EUR (and the equivalent in other currencies), the Application shall not require two-factor authentication of the payment.

8 Personal Data Protection Principles

  1. Zásilkovna (hereinafter also referred to as the "Controller") processes in its activity, within the meaning of Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation"), the following personal data of Users:

    • For natural persons: name and surname; e-mail address; telephone number; bank account number; User's payment card details;

    • For companies: name and surname of contact persons; telephone number of contact persons; e-mail address of contact persons; company name; web address of the shop; company e-mail address; billing address; ID (Identification Number), VAT ID; bank account number.

  2. The above-mentioned personal data must be processed for the purpose of identifying the contractual parties and fulfilling the Contract and also for the purpose of recording the contract and future possible application and defense of the rights and obligations of the contractual parties. Such processing is enabled by:

    • Article 6 paragraph 1 letter b) of the Regulation – processing necessary for the performance of the contract, and

    • Article 6 paragraph 1 letter f) of the Regulation – processing necessary for the purposes of the legitimate interests of the controller or a third party.

    Furthermore, Zásilkovna also uses personal data to provide Users with relevant content, i.e., content that is interesting to them. Based on a legitimate interest, Zásilkovna processes in this way especially personal data that is processed automatically and cookies. For the same legal reason, Zásilkovna may send email and SMS messages to Users as customers. The processing of personal data on this legal basis also takes place during monitoring performed through cameras at Zásilkovna's individual premises. For the purposes of sending commercial communications (email marketing) and telemarketing, Zásilkovna processes personal data based on consent. If the User does not give consent, and they are a User, Zásilkovna may send commercial communications (or call them as part of telemarketing) even without them giving consent. In any case, the User can easily prohibit such marketing communication by sending an email to privacy@zasilkovna.cz or by clicking on the link in the commercial communication – unsubscribe. If the User gives consent to the processing of personal data, they can revoke it at any time. Recipients using the Application hereby give Zásilkovna consent to be informed about the possibility of collecting the Shipment via the Application.

  3. Zásilkovna processes the personal data of Users for these reasons:

    • provision of services: to properly equip and deliver your Shipment. If any problems arise, thanks to your personal data, Zásilkovna knows who to contact;

    • customer care: if you contact Zásilkovna with a question/problem, Zásilkovna must process your data to answer/solve it. In some cases, personal data may also be passed on to third parties (e.g., carrier);

    • user account: a number of useful functionalities will be made accessible thanks to the personal data provided in the user profile;

    • marketing activity: email marketing: email commercial communications are sent based on a legitimate interest. Marketing calls are conducted for the purpose of offering services, and related marketing communication. The legal basis for processing the telephone number is either consent or at least the legitimate interest in conventional direct marketing;

    • improving services: using the history of orders and behavior on the website, Zásilkovna can offer more relevant service offers;

    • customer service ratings: after purchasing services, the User may be asked to rate them. Ratings can also be entered on their own initiative;

    • Customer Service: if the User contacts customer service, Zásilkovna may record the telephone call after prior notice, serving to check the quality of services provided by employees;

    • assertion of rights and legal claims and control by public authorities: Zásilkovna may process personal data because it needs it to assert rights and legal claims (e.g., in the event of an unpaid receivable). Furthermore, Zásilkovna may process personal data for the purposes of controls carried out by public authorities and for other similarly serious reasons.

  4. When visiting the Zásilkovna website, Zásilkovna may collect certain information, such as IP address, date and time of access, information about the internet browser, operating system, or language setting. Zásilkovna may also process information about the behavior of persons on its websites (e.g., what links they visit). However, information about web behavior is anonymized for maximum privacy and cannot be assigned to a specific User. If the User accesses the websites from a mobile phone or similar device or via the mobile applications, Zásilkovna may also process information about the mobile device (data, records of application failure, etc.). Cookies are also automatically processed.

  5. If a person accesses the Zásilkovna websites from a phone, tablet, or similar device, Zásilkovna optimizes them for these devices. Personal data are processed in a similar way as in the case of access from a computer. A prerequisite for using the services according to these Conditions is downloading the Application. If the person allows the Application to use location data, the location of their device may also be used to provide them with greater user comfort and more relevant service offers (e.g., displaying the nearest Pick-up Point). The data collected in this way may also be used by Zásilkovna to send tailor-made commercial communications to the User. If the User does not wish this, they can easily unsubscribe completely from receiving commercial communications.

  6. Personal data shall be processed by Zásilkovna for the above-mentioned purpose for the duration of the contractual relationship and further for a period of 10 years from the termination of the contractual relationship, unless another legal regulation requires the retention of contractual documentation for a longer period.

  7. Users have the right under the Regulation:

    • to request information from Zásilkovna on what personal data of Users it processes,

    • to request access to this data from Zásilkovna and have it updated or corrected, or request restriction of processing,

    • to request the erasure of this personal data from Zásilkovna. Zásilkovna shall carry out this erasure, unless it is contrary to law or the legitimate interests of Zásilkovna,

    • to effective judicial protection if the User believes that their rights under the Regulation have been violated due to data processing contrary to this Regulation,

    • to data portability,

    • to request a copy of the processed personal data,

    • to file a complaint with the Office for Personal Data Protection,

    • to object to processing based on the legitimate interest of Zásilkovna.

9 Final Provisions

  1. Zásilkovna has the right to change or supplement these Conditions at any time to a reasonable extent, especially due to changes in legal regulations, technological changes affecting the functions of the Application or the handling of User data or personal data, but also due to the expansion or changes of the Application, or the introduction of new services by Zásilkovna.

  2. The contractual relationship according to these Conditions, as well as the claims arising from it, are governed by the Czech legal system, especially the Civil Code and the Copyright Act.

  3. These business conditions are in a format accessible for reading by assistive technologies.
